Managing Chapter 13 Bankruptcy Cases in Virginia
If you have fallen behind on your vehicle loan payments, filing a Chapter 13 bankruptcy case can prevent your vehicle from being repossessed.
Filing Chapter 13 can help you regain your vehicle if it was already repossessed.
Under Virginia law, your vehicle loan creditor has to wait ten days from the date of the repossession before moving forward with selling your vehicle. If you file bankruptcy before the car is sold, our lawyers can help you get your vehicle back and secure it going forward.
You need your vehicle and not having access to transportation is not an option. You do not have to fight your vehicle creditor alone. The right legal representation can significantly improve your financial situation for years to come.
Adjusting Your Car Loan is The Right Turn To Take
Bankruptcy may allow you to pay less than you owe for your vehicle loan.
In some cases, you may also adjust the terms of your vehicle loan and pay back less than what you owe on the loan, keep the vehicle, and get your title at the end of your case.
If you financed your vehicle more than 910 days before filing a Chapter 13 bankruptcy, you are only required to pay up to the value of the vehicle, even if that amount is less than what you owe on the loan.
For example, if you meet the time requirements and you owe $20,000 on your car loan, but the car is valued at only $10,000, including the loan in a Chapter 13 bankruptcy would allow you to pay only the $10,000 value. Paying up to the value will satisfy your loan and you’ll gain your title.
Additionally, if you have refinanced your vehicle loan or if you used the vehicle title as collateral for a loan, you would only need to pay the value of the vehicle in order to satisfy the loan and get your title.

Finish Your Vehicle Payments Through Bankruptcy
You can keep and pay off your vehicle through a Chapter 13 bankruptcy. In Chapter 13, you make one bankruptcy plan payment each month, usually over a period of three to five years.
That monthly payment could cover your vehicle loan, as well as all your other debts, including:
- Missed mortgage payments
- Missed rent payments
- Child support
- Spousal support arrears
- Tax debts
- Student loans
- Furniture loans
- Credit cards
- Medical bills
You will get the legal assistance needed to make sure you have the most affordable payment possible.
In many cases, the monthly bankruptcy plan payment is significantly less than the minimum amount you are paying on these debts outside of bankruptcy.
You also have the option to include only the missed vehicle loan payments in your bankruptcy and continue to make the ongoing regular monthly vehicle loan payments going forward.
